What to Know if You’ve Been Charged with a DUI
If you have been charged with DUI, there are some things you must do immediately. The following is a condensed checklist of priorities that may be involved in your case.
First, you may have as little as seven (7) calendar days to challenge your driver’s license revocation or risk losing your driving privilege in Colorado, and across the country, for at least nine months. Requesting your DMV hearing involves making sure you have the right documents and properly answering questions when requesting your hearing to best set up your case for the future. Note that the driver’s license revocation proceedings are separate and apart from your criminal charges in court and require immediate action on your behalf to challenge a driver’s license loss and keep your immediate driving privileges intact.
Also, you may need to get into court before your first scheduled court hearing if you have pending issues, such as out-of-state travel. An attorney can advise how to address these issues immediately with the court while the charges are pending.
Finally, there are many other reasons to act immediately, such as preservation of evidence, producing a mitigation plan, and strategizing for the best possible outcome. While a DUI case takes anywhere from 3-6 months to resolve in court, and potentially longer if a trial is involved, what you do in the first week after arrest can have a direct impact on the result.
