2014 Promises Big Changes for Colorado DUI Laws

What does it mean to be persistent? According to online dictionary sources, persistent means: continuing firmly or obstinately in a course of action in spite of difficulty or opposition. Which of course, can mean a good thing, for example in the pursuit of a college degree or career aspirations. However, the word ‘persistent’ when used in conjunction with Colorado’s DUI laws is not a good thing. As a matter of fact, if you find yourself facing ‘Persistent Drunk Driving’ charges, you will need to seek Denver DUI defense immediately.

A classification of ‘persistent drunk driving’ carries far stiffer penalties than your first time offense or perhaps regular DUI charge. This bill, originally passed in 1998, is designed for those driver’s with excessively high BAC (Blood Alcohol Content) or have repeatedly found themselves arrested for driving under the influence. You can be facing such a charge if you are pulled over on suspicion of drunk driving and found to have a high enough BAC level or if you refuse to take a blood, urine or breathalyzer test.

Cracking down on drunk drivers, starting January 1st, 2014, Colorado lawmakers further reduced the driver’s BAC levels from .17 to .15. Even if you have never been arrested for drunk driving, you can be facing this rather severe and dubious charge of ‘persistent drunk driving’ depending on the results of your blood alcohol level. No doubt, high alcohol content is a factor when facing a DUI.
